  1. General Provisions
    1. These Terms and Conditions constitute an appendix to the Terms of Service and the terms written in capital letters should be understood accordingly.
    2. In these Terms and Conditions, the following terms, which are written in capital letters, shall be understood as follows:
      1. “AVA Awards” – online competition with prizes organised by the Provider via Platform;
      2. “Participant” – a User who accepted these Terms and Conditions and submitted the Content for the AVA Awards, and is not an employee or associate of the Provider, Sponsor, or spouse, ascendant, descendant or sibling of such employee or associate;
      3. “Sponsor” – an entity that sponsors the prizes for the AVA Awards;
      4. “Terms and Conditions” – these Terms and Conditions, that set out the principles for the AVA Awards, available at the Platform.
  2. AVA Awards Rules
    1. Winners of the AVA Awards will be selected in the following categories:
      1. Still image (individual);
      2. Still image (studio);
      3. Animation (individual);
      4. Animation (studio).
    2. Participant submits the Content for the AVA Awards via their Account.
    3. Content for the AVA Awards can be submitted from 26th April 2023 to 30th June 2023 until 23:59 (GMT+2).
    4. Content that does not meet the requirements referred to in clause 2.1 and that is submitted in a different manner and outside the deadline indicated in clause 2.3 will not be considered for the AVA Awards.
    5. Participant may submit only five pieces of Content for one category indicated in clause 3.1. If more than five pieces of Content are submitted for a given category, only the five pieces of Content that were submitted first will be included in the AVA Awards.
    6. It is prohibited to submit the same piece of Content for multiple categories. Violation of the prohibition referred to in the previous sentence will result in disqualification from the AVA Awards.
    7. The best 3 (three) Content within each category will be selected and awarded prizes in the AVA Awards.
    8. Participant declares that their Content is not burdened with any legal defects, and in particular does not infringe on any third party’s intellectual property rights, including copyrights, and/or personal rights.
    9. Reading and accepting the Terms and Conditions is a prerequisite for participation in the AVA Awards.
    10. Participation in the AVA Awards is free of charge and voluntary.
  3. Provider’s competences
    1. Provider is entitled to:
      1. disqualify Participants who have violated the provisions of these Terms and Conditions, and/or Terms of Service, and/or generally applicable law;
      2. disqualify Participants whose Content is racist, chauvinistic, xenophobic, inciting hatred or aggression, in particular on racial, ethnic, religious, sexual or otherwise discriminatory grounds, or inciting violation of the law or behaviour contrary to good morals, or is vulgar in nature;
      3. disqualify Participants whose Content constitutes an unsolicited message containing promotions, political campaigning, advertising or solicitations.
  4. Award ceremony, jury, and prizes
    1. In order to select the winners of the Competition, the Provider will appoint a nine-person jury to evaluate the submitted Content, taking into account criteria such as ingenuity, technical skills, aesthetics, realism, and overall impact.
    2. From among all Participants, the jury will select 3 (three) winners, awarding them first, second and third place respectively.. The winners will be selected by voting.
    3. The decision of the jury is final and cannot be appealed.
    4. The prizes awarded in the AVA Awards are:

    5. The prizes Sponsors are: Autodesk, Design Connected, Chaos Group, iToo Software, Exlevel, Humano 3D, Humano 2D, Friendly Shade, Render People, Globe Plants, Evermotion, Rebus Farm, Forest Digital, D5 Render, Nouvellemesure Lab, HDR Maps, Modelat, Reawote, KStudio, LotPixel, Huion.
    6. The prizes awarded in the AVA Awards may only be handed over in the form specified in these Terms and Conditions, without the possibility of payment of their equivalent in cash or exchange for another prize, and may not be transferred by the winner of the AVA Awards to a third party.
    7. A participant may receive a maximum of one prize in the AVA Awards in the category.
    8. The results of the competition will be published on 20th July 2023 on the Platform.
    9. The winners of the AVA Awards will be informed by the Provider of their winnings by email.
    10. Any potential tax consequences of receiving a prize shall be borne by the awarded winner of the AVA Awards.
    11. The Provider reserves the right to resign from selecting the winner in general.
  5. Awarding of prizes
    1. In order to deliver the prizes of a tangible nature to the winners of the AVA Awards, the Provider will contact each winner with a request to send the data necessary for the delivery of the prize (i.e. name, surname, mailing address, telephone number) to the agnieszka@archvizartist.com.
    2. The prizes of a tangible nature will be sent to the winners of the AVA Awards within a maximum of 30 (thirty) days from the date of receiving from the given winner the data referred to in clause 5.1. above. If the winner of the AVA Awards does not provide the Provider (at the Provider’s request) with the data referred to in clause 5.1. within 7 (seven) days from the date of announcement of the results of the AVA Awards, the Provider reserves the right to transfer the prize to the next Participant indicated by the jury or to resign from awarding the winner in general.
    3. The shipment of prizes of a tangible nature to the winners of the AVA Awards will be carried out at the Provider’s expense.
    4. The prizes of an intangible nature will be provided to the winners of the AVA Awards email addresses indicated in the Platform, within 30 (thirty) days from the date of announcement of the results of the AVA Awards.
  6. Miscellaneous
    1. These Terms of Service enter into force on 26th April 2023.
    2. In matters not covered by these Terms and Conditions, the provisions of the Terms of Service are applicable.
    3. Complaints regarding matters related to the AVA Awards should be submitted to the Provider by e-mail to the email address: agnieszka@archvizartist.com, or by post to the postal address of the Provider indicated on the Platform, within 14 (fourteen) days from the date of AVA Awards completion.
    4. Complaints regarding:
      1. prizes of a tangible nature should be submitted within 14 (fourteen) days from the date of prize delivery, and in the case of non-delivery due to reasons for which the Provider is responsible, from the lapse of the deadline referred to in clause 5.2;
      2. prizes of an intangible nature should be submitted within 14 (fourteen) days from the lapse of the deadline referred to in clause 5.4.
    5. Complaints sent in breach of the deadlines referred to in this section 6 shall not be considered.
    6. Complaints will be considered by the Provider within 14 days of their receipt.
    7. The Provider reserves the right to change these Terms and Conditions for important reasons such as funding additional prizes, adding new categories to the AVA Awards, the occurrence of extraordinary circumstances that make it necessary to change the date of commencement or completion of the AVA Awards.
    8. In the event of a change to the Terms and Conditions, the Provider will post the relevant information on the Platform about the change, the reason for the change and the date from which the change takes effect, as well as post the updated Terms and Conditions on the Platform and inform each Participant by email.
    9. The Provider reserves the right to cancel the AVA Awards, as well as to change its date. In the event of cancellation of the AVA Awards, only those Participants who have completed the submitted the Content up to the date of its cancellation and whose Content has been positively evaluated by a jury appointed by the Provider are entitled to the prize.
